   FCKLCK Studio (“FCKLCK”, “we”, “our”) respects your privacy and is committed to protecting your personal data. By using our website and engaging our services, you agree to the terms set forth herein, including our use of cookies and data handling practices as described in this document.

Service Terms & Client Engagement

These terms apply to all projects and client relationships with FCKLCK Studio.

9. Scope of Engagement
   FCKLCK may provide creative and strategic services, as outlined in individual Statements of Work (SOWs), which specify deliverables, timelines, and fees. Any changes to the scope must be submitted in writing and may result in revised timelines or fees. We may withhold personal information that you request to the extent permitted by law.

10. Delivery
    FCKLCK will make commercially reasonable efforts to meet agreed timelines, but is not liable for delays caused by client inaction, late feedback, or changes to the scope. Any such delays may result in additional costs or extensions.

11. Ownership & Licensing
    Full and exclusive ownership of the selected concept and its related final deliverables transfers to the client only upon receipt of full payment of all fees due.

All other ideas, concepts, and directions presented by FCKLCK during the course of the project, but not selected by the client, remain the sole intellectual property of FCKLCK. FCKLCK reserves the right to reuse, repurpose, or present these materials to other clients or for its own initiatives — including within related or competitive industries.

FCKLCK retains the right to use the final work and/or selected deliverables for promotional purposes, including portfolios, social media, press, and award submissions, with prior notification to the client.

12. Payment Terms
    Invoices are issued monthly unless otherwise stated in the relevant SOW. All invoices are payable within 14 calendar days of the invoice date.

FCKLCK invoices reflect the full amount due. The client is responsible for ensuring the total invoiced amount is received by FCKLCK. Any bank charges, transaction fees, or currency conversion costs are to be covered by the client.

Any work falling outside the scope of the agreed deliverables will be charged on a time and materials basis at FCKLCK’s prevailing rates. Prior written approval from the client is required for any additional charges.

13. Confidentiality
    Both parties shall treat as confidential all information disclosed in the course of the engagement that is marked or reasonably understood to be confidential. Confidentiality obligations remain in force during and after termination of the engagement. Exceptions apply for information that is:

• Publicly known or becomes so through no fault of the recipient;
• Already lawfully in the recipient’s possession;
• Disclosed pursuant to legal obligations.

14. Termination
    Either party may terminate the agreement, in whole or in part, in writing with immediate effect if:

• The other party materially breaches its obligations and fails to remedy the breach within 15 days of receiving formal notice;
• Insolvency, liquidation, or similar legal proceedings are initiated against the other party.

Upon termination, the client remains liable for any unpaid work completed up to that date.

15. Governing Law & Jurisdiction
    These Terms of Service are governed by and construed in accordance with the laws of the Netherlands.

All disputes arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.

16. Your Rights
    You may request access to the personal information we hold about you. Requests may be subject to verification and applicable legal limitations.

17. Third-Party Links
    Our website may contain links to third-party websites. We are not responsible for the privacy policies or practices of third parties.

18. Cookie Policy
